  • Workers comp for a nanny???

    I need workers comp for my nanny. I called my renters insurance policy and they said that I need to go through my auto insurance to get umbrella coverage to include liability insurance for the Nanny. But, when I called my auto insurance, they said that’s personal umbrella policy won’t work, that I need a commercial policy. Is this true? How did you all get Worker’s Comp. for your Nanny? 
    What companies do folks use for Worker’s Comp. for their nannies?  I got a quote from State Fund, then from another company that my therapy colleague gave. The company is called Biverk through Hartford. They seem less expensive than state fund. Any advice?

    We use Bhalu Insurance. They were about $100 cheaper annually than Biberk, although I think both are ultimately underwritten by Berkshire Hathaway.

    We got it directly through Hartford at the time (10 years ago) because our homeowner's insurer wasn't offering it back then. Now I believe it's required for homeowner's policies in CA (but sounds like maybe not for renter's?) It was not hugely expensive but still a pain to have to manage separately.

    It sounds like your renter's insurance provider is likely mistaken. I am not a lawyer, and this is not legal advice, but my understanding is that all renter's and homeowner's policies in California are required by law to include worker's comp coverage for household employees. I believe the standard rider for this is called HO 0090, and it should be part of your renter's policy.

    California has special rules when it comes to domestic employees like nannies or other childcare workers. For purposes of workers' comp, household workers aren't considered employees if they worked less 52 hours or earned no more than $100 in the 90-day period before the injury. Because your nanny will be working full-time, she will be covered under workers' comp.

    I'm trying to understand what requirements my husband and I have regarding purchasing worker's comp insurance since we will be entering a nanny share with another family but the care of our children will take place at their house (which they own and have worker's comp insurance through). Did you go through this with any families you nanny shared with? What worker's comp insurance vendors do you recommend if this is something you pursued?

    Yes, this was our situation. The other family held the workers' comp policy through their insurance, and we contributed to the cost since we were joint employers of our nanny. I think they just got a referral from their primary home insurance company (which did not offer it).
